Refine Multiple Checkbox Results on 1.3.7

Ok so finally got the refine results working on the checkboxes so that results are shown.

HOWEVER

I dont think its working as it should?

Heres my example.

I have a checkbox that has the options - small,medium,large,xlarge

if a poster ticks, small the following happens:

when refining results if you tick small, the post is shown

if you tick small & medium, the post is still shown.

surely the point of refine results is to narrow the result, show if a user specifically wants small & medium, they dont want to be show the results of small OR medium?

perhaps some do I don't know? but is there a way I can change it so that instead or saying OR, it checks agains AND ?
