Allowing to post adds in parent category, when empty does not work

I have sub categories for most of my ad categories, but there is one category where I do not have sub categories.
Because of this I have changed the settings allowing post on main categories, to "When empty"

But if I select this category when posting an add, it behaves just like it is not allowed to post on the main category.
The continue button is not displayed.
